Cyprus court confirms: outstanding service charges cannot block property transfer
Debts for common building expenses accumulate over years on Cyprus, but this will not prevent you from obtaining ownership rights to a property.
A Cypriot court has confirmed that if you have paid the purchase price in full and met all contractual conditions, the seller cannot block the transfer of ownership rights due to disputed service charges, taxes or utility bills—regardless of the sums involved.
The vendor may still pursue payment, but only through the courts in a separate civil action. The law protects buyers who have waited years for documentation from seller coercion, whilst simultaneously preserving the seller's right to recover funds through legal proceedings.
There is only one exception: if the contract or law explicitly stipulates that transfer depends on payment of taxes, municipal fees or sewerage charges—in that case, such debts may indeed obstruct the process.
For investors, the key takeaway is clear: disputed debts should not become a tool for pressuring the buyer. Ownership is ownership.
