Spain's Supreme Court voids short-term rental registry; property owners seek refunds

Spain's Supreme Court has annulled the national register for short-term lettings, prompting property owners to demand reimbursement of registration fees they have already paid.

The difficulty lies in the fact that the system operated for only a few months. Owners paid registration fees and complied with all requirements, only for the court to declare the registry unlawful. The question now arises: are they entitled to compensation?

According to Spanish property lawyer Alejandro Fuentes-Loho, the answer is yes, but with conditions. Funds can be recovered, though owners will need to file an administrative claim and demonstrate that the payment was made in good faith. The process may be protracted, but prospects exist.
