The short-term rental sector in Spain is preparing claims for compensation to almost 500000000 EUR following the repeal of the register by the Supreme Court. The Tourist Housing Federation (Fevitur) estimates the loss of property owners in 496000000 EUR. On average, each owner suffered losses around 33000 EUR due to lost profits and the cost of complying with the illegal system. The court pointed out that the decree exceeded the powers of the state by creating a national register instead of coordinating regional systems. A Council of State lawyer confirmed that the authorities ignored warnings about the legal vulnerability of the decree. Fevitur is exploring the possibility of legal action for damages to owners. The question remains about the validity of previously issued registration numbers, according to registrars, they remain in force, but industry lawyers believe otherwise.
